Obtaining valid consent is a fundamental requirement in acupuncture and all healthcare practices. It protects the public, supports professional standards, and underpins safe, ethical treatment.

The Acupuncture Regulatory Authority promotes clear, consistent approaches to consent across the profession.

The role of consent in safe practice

Consent is more than permission. It is a process that ensures individuals really understand and agree to the care they receive.

For consent to be valid, three elements must be present:

  • it must be given voluntarily
  • the individual must have capacity to understand what they are agreeing to
  • sufficient information must be provided to make an informed decision

Failure to obtain appropriate consent can lead to ethical breaches, legal consequences, and loss of public trust.

Providing clear and appropriate information

Practitioners are responsible for ensuring patients understand:

  • the nature of the treatment
  • how it will be carried out
  • potential benefits and risks
  • any expected reactions

This enables patients to make informed decisions about their care and reinforces transparency within the practitioner-patient relationship.

Maintaining consent throughout treatment

Consent is not a single event. It should be reviewed and reaffirmed where appropriate, particularly the following:

  • during longer or evolving treatment sessions
  • when techniques or approaches change
  • when working in sensitive or intimate areas

Ongoing communication ensures that patient autonomy is respected at all times, and when changes occur, if necessary, pause the treatment and re-explain, gaining further consent.

Professional boundaries and dignity

Maintaining clear professional boundaries is essential to ethical practice.

Practitioners should:

  • seek permission before any physical contact
  • ensure patient comfort and dignity when clothing removal is required
  • provide appropriate privacy and coverings
  • communicate in a professional and respectful manner

These measures support both patient wellbeing and practitioner accountability.

Comprehensive records are essential in demonstrating that valid consent was obtained.

Documentation should include:

  • details of the information provided
  • confirmation of consent
  • relevant clinical notes and observations
